These Terms & Conditions ("Agreement") govern all estimates, quotations, proposals, work orders, invoices, contracts, services and installations performed by Epoxy Boss Florida Inc. ("Epoxy Boss Florida," "Contractor," "we," "our," or "us"). By approving an estimate, signing a proposal, paying a deposit, requesting work to commence, or otherwise authorizing the project, the client ("Client," "Owner," or "Customer") agrees to be bound by these Terms & Conditions. This Agreement shall be governed by the laws of the State of Florida.
Epoxy Boss Florida shall provide only the services specifically described within the approved estimate, proposal or contract. Any work not expressly included shall be considered additional work requiring a written Change Order approved by both parties prior to commencement. Project pricing is based upon the information available at the time of estimating and assumes reasonably accessible, structurally sound concrete suitable for installation of the specified flooring system.
Every concrete slab is unique. Existing concrete may contain hidden defects, contamination, moisture conditions, structural movement, previous repairs, existing coatings, curing compounds, oil saturation, weak concrete, delamination, excessive cracking or other conditions that cannot always be identified during a visual inspection. Epoxy Boss Florida performs reasonable pre-installation evaluations; however, concealed or latent conditions may only become apparent after mechanical surface preparation begins. If unforeseen conditions are discovered that require additional preparation, repairs or materials to achieve an acceptable installation, work may be suspended until the Client approves a written Change Order reflecting any additional cost and schedule adjustments.
Concrete is not a manufactured finish but a natural construction material that varies in strength, porosity, density, color, aggregate exposure and moisture content. Existing slabs may continue to shrink, expand, settle or crack throughout their service life. Hairline cracks, control joint movement, slab movement, minor surface imperfections, aggregate exposure, patch visibility, existing repairs and future concrete movement are normal characteristics of concrete and shall not be considered installation defects or warranty claims.
Epoxy Boss Florida installs complete flooring systems that may include mechanical surface preparation, crack and joint repair, primers, moisture mitigation systems where specified, epoxy, polyurea, polyaspartic, polyurethane, aliphatic urethane, decorative flake, quartz, metallic pigments and protective topcoats. Product selection is determined based upon the intended use of the space, environmental conditions and substrate characteristics. Unless specifically stated within the proposal, no particular manufacturer, product line or installation method is guaranteed.
Mechanical diamond grinding and other appropriate preparation methods are performed to establish a suitable concrete surface profile for coating adhesion. Surface preparation does not permanently eliminate future concrete movement, structural cracking, moisture migration or substrate deterioration. Acid etching is not used as a substitute for professional mechanical preparation unless specifically stated in writing.
Concrete naturally contains moisture, and moisture conditions may change over time due to groundwater, weather, plumbing failures, irrigation, hydrostatic pressure or other environmental factors. Unless a moisture mitigation system is specifically included within the project scope, Epoxy Boss Florida does not guarantee protection against future moisture vapor transmission or hydrostatic pressure. Moisture-related failures caused by conditions developing after installation are excluded from warranty coverage.
Decorative flake, metallic, quartz and other hand-applied flooring systems are artisan finishes. Minor variations in color, flake distribution, aggregate exposure, texture, sheen, gloss level, patch visibility and overall appearance are inherent characteristics of decorative flooring systems and shall not be considered defects. Digital photographs, samples and marketing materials are intended to represent general appearance only and are not exact reproductions of the final installation.
Outdoor concrete is subject to direct sunlight, standing water, weather exposure, thermal expansion, ultraviolet radiation, wind-driven rain, salt air and environmental contaminants. While outdoor coating systems are selected for these conditions, environmental exposure may accelerate normal aging compared to interior installations. Changes in gloss, color or appearance resulting from normal weathering shall not constitute warranty defects.
The Client shall provide unrestricted access to the project site, maintain a safe work environment, ensure adequate electricity, water, lighting and ventilation where required, remove vehicles, furniture, equipment and personal belongings prior to installation unless otherwise agreed, disclose known substrate conditions and obtain any approvals required by homeowners' associations or property management. Delays caused by restricted access, unavailable utilities or failure to prepare the work area may result in additional charges or schedule adjustments.
Estimated project dates are provided in good faith but are not guaranteed completion dates. Weather conditions, humidity, substrate conditions, material availability, labor shortages, utility interruptions, government actions, hurricanes, tropical storms, force majeure events, client-requested changes and other circumstances beyond our reasonable control may require schedule adjustments without constituting breach of contract.
Unless otherwise agreed in writing, a deposit is required before scheduling materials and labor. Remaining balances are due according to the executed proposal or invoice. Late payments may accrue interest at the maximum rate permitted by applicable Florida law together with any reasonable collection costs, attorney's fees and court costs where recoverable by law. Epoxy Boss Florida reserves the right to suspend work, delay scheduling or withhold warranty documentation until all outstanding balances have been paid in full.
Any modification to the original scope of work, including additional preparation, repairs, design changes, material upgrades, scheduling changes or unforeseen substrate conditions, shall require a written Change Order approved by both parties before the additional work is performed. Change Orders may affect pricing, material quantities and project completion dates.
Project scheduling reserves labor, equipment and materials specifically for each Client. Cancellation requests must be submitted in writing. Deposits may be partially or fully retained to recover costs incurred for scheduling, custom materials, administrative expenses or work already completed, as permitted by applicable law and the executed contract.
Warranty coverage is governed exclusively by the written Epoxy Boss Florida Limited Warranty issued for the completed project. The warranty applies only to qualifying defects specifically identified within the written warranty documentation and does not extend to conditions excluded therein. Manufacturer warranties, where applicable, remain separate from and independent of the Epoxy Boss Florida Limited Warranty.
The Client agrees to follow the Maintenance & Care Guide provided upon project completion. Failure to follow recommended maintenance procedures, use of incompatible chemicals, improper cleaning methods, abuse, misuse or unauthorized repairs may void warranty coverage for the affected area.
The Client agrees to follow all curing instructions provided at project completion before allowing foot traffic, vehicle traffic, equipment placement or cleaning. Premature use of the flooring system may permanently damage the coating and is not covered under warranty.
Although many flooring systems may include slip-resistant additives, no flooring surface is completely slip-proof. Slip resistance varies depending upon footwear, contaminants, water, oils, cleaning products and environmental conditions. The Client remains responsible for maintaining safe walking conditions and promptly removing contaminants from the surface.
If the Client believes a warranty condition exists, Epoxy Boss Florida shall be provided reasonable written notice and the first opportunity to inspect and, if applicable, repair the alleged defect before any third party performs repairs or modifications. Unauthorized repairs may void warranty coverage for the affected area.
Unless otherwise requested in writing before installation begins, the Client grants Epoxy Boss Florida permission to photograph and video the project before, during and after installation for documentation, quality control, training, portfolio, website, social media and marketing purposes, provided that personally identifiable information such as addresses, license plates or occupants is not intentionally disclosed without additional permission.
The Client shall inspect the completed project within fourteen (14) calendar days following substantial completion and promptly notify Epoxy Boss Florida in writing of any concerns reasonably believed to require correction. Minor cosmetic variations consistent with decorative flooring systems or industry standards shall not constitute incomplete work. Continued use of the flooring system following completion shall constitute acceptance of the installation except for valid warranty claims.
To the fullest extent permitted under Florida law, Epoxy Boss Florida's total liability arising from any claim relating to the project shall be limited to the amount actually paid by the Client under the applicable contract. Under no circumstances shall Epoxy Boss Florida be liable for incidental, indirect, consequential, exemplary, punitive or special damages, including but not limited to loss of use, business interruption, lost profits, relocation expenses, damage to personal property, loss of revenue or replacement of surrounding materials, except where such limitation is prohibited by applicable law.
The Client agrees to indemnify and hold harmless Epoxy Boss Florida, its officers, employees and subcontractors from claims, damages or expenses arising from unsafe site conditions, inaccurate information provided by the Client, unauthorized modifications, third-party work or conditions outside the Contractor's reasonable control, except to the extent caused by Epoxy Boss Florida's proven negligence or willful misconduct.
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Florida without regard to conflict of law principles. Unless otherwise required by applicable law, any legal action arising from this Agreement shall be brought exclusively in a state or federal court having jurisdiction in Broward County, Florida.
If any provision of this Agreement is determined to be invalid, illegal or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms & Conditions, together with the approved proposal, project estimate, Change Orders, Completion Certificate and written Limited Warranty, constitute the complete agreement between the parties and supersede all prior oral or written discussions, representations or understandings regarding the project. No modification shall be effective unless made in writing and signed by both parties.
